Notice of Ex Parte hearing

I spoke to you on the telephone a little while ago to notify you of my intention to request an ex parte hearing on Friday, February 10, 2012. I reiterate herein that notice.

On Friday, February 10, 2012 I will be requesting an ex parte hearing in our custody/visitation case (case no. TD035397). The hearing will be at the Compton Courthouse, 200 W. Compton Bl, 12th Floor, Compton, CA at 8:30am.

I will be seeking, amongst other things, the following:

• supervised visitation, at your expense, to be held only in Los Angeles County;
• that you be required to pass a drug test within 48 hours of having any direct contact with Gabriel, and drug testing at regular intervals during any period of unsupervised visitation;
• that you be precluded from possessing or using any drugs, including marijuana, during any period of visitation;
• that Kristopher Lauchner not be permitted within 100 yards of Gabriel.

I will email you a copy of the forms and my declaration as soon as they're ready (probably Wednesday). I will also forward you a hard copy as soon as they're printed. If you will be appearing in person, however, I can furnish you a copy at that time because it would take longer to mail them to you.

Please note: this ex parte hearing seeks the same things I am seeking in the Order to Show Cause I filed last week. However, the hearing date for the OSC is set for August 15, 2012 and there are periods of visitation scheduled between now and then. That is why I am requesting the ex parte hearing. Alternatively, if you provide me a statement, in writing, that you will not be exercising your visitation right for the President's Day weekend I can hold off until the child support hearing on February 21, 2012 to save you the time and expense of having to make two appearances. If you provide such prior to Friday, February 10, 2012 I will request the ex parte hearing on the day of the child support hearing.
